What is the ERC Backlog Report?

Tens of thousands of taxpayers around the country have been waiting over a year for an update on their ERC claim. In early Novemeber, 2024, Erin Collins, the National Taxpayer Advocate, stated it is imperative that the IRS pays all legitimate claims. She went on to note that the ERC backlog includes a lot of good taxpayers in there that are entitled to this money and that she disagrees with the IRS that fraud is rampant in the program.


Recently, the HIRE Coalition created the ERC Backlog Report to uncover the scale of unprocessed ERC claims in congressional districts across the country. On average, about 4-5% of these pending ERC claims were filed after January 31, 2024—these claims are at risk of being retroactively disallowed if the Employee Retention Tax Credit Repeal Act is passed in its current form.


What Are Our Sources?

The data is based on data provided by HIRE Coalition members and allies, which include CPAs, attorneys, and tax professionals. Based on our estimates, these numbers represent between 5-10% of all pending ERC claims. Therefore, the actual amount of pending claims in any one district is likely higher than the numbers contained in our data.
