#1 Most Serious Problem Encountered by Taxpayers: Employee Retention Credit
The National Taxpayer Advocate (NTA) Annual Report to Congress (), lists the ERC as the #1 most serious problem encountered by taxpayers. The NTA devotes 17 pages to the ERC, citing IRS decisions that led to a backlog of 1.2 million claims and a large number of erroneous denials based on faulty, undisclosed risk analytics. Among several recommendations, the NTA calls on the IRS to process all claims made prior to by , and all remaining claims by .

The backlog of unprocessed ERC claims is currently over one million. Through our ERC Backlog Report, HIRE endeavors to uncover the scale of unprocessed ERC claims in each state and Congressional district. The report is a work in progress as we collect data from across the country.
